The Petitioners seek quashing of the entire proceeding including the order of cognizance dated 28.01.2014 passed by the Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S. Case No. 95 of 2013.

The case of the Informant is that in a Title Suit which was pending before the Sub-Judge-III, Saharsa the Petitioner executed a false Sale-deed.

Considering that this will be a subject-matter of the Title Suit and not a criminal case, the application is allowed and the entire proceeding including the order of cognizance dated 28.01.2014 passed by the Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S. Case No. 95 of 2013 is, hereby, set aside.

The Application stands allowed.

The parties are at liberty to raise their objections before the relevant Court.
