Heard learned counsel for the parties.

This petition has been filed by the petitioner for restoration of Letters Patent Appeal No.951 of 2012 which was dismissed on 31.07.2012 for non-prosecution.

Although learned counsel for the opposite parties vehemently opposes the contentions of learned counsel for the petitioner, but from the facts and circumstances it appears that genuine reasons have been shown which prevented learned counsel for the petitioner from appearing in Court on the said date.

Accordingly, this petition is allowed and Letters Patent Appeal No.951 of 2012 is restored to its original file and number.
