It is also submitted that the writ application was dismissed earlier on account of non-compliance of the peremptory order dated 19.9.2008 and therefore the petitioner be given a last opportunity to pursue his remedies by restoring the earlier restoration application. On a consideration of the facts and circumstances of the case, MJC No. 266/2009 is directed to be restored to its original file. The application is, accordingly, disposed of.
