The petitioner has approached this Court under Article 226 of the Constitution of India seeking a direction to the respondents for granting him promotion on higher post and also for grant of benefits of ACP and other consequential benefits.

Learned counsel for the petitioner submits that for redressal of his valid grievances, he has filed his representations before the authorities concerned, yet neither his valid grievances have been redressed nor his representations are being disposed of.

After having heard the parties and on consideration of

the materials available on record, this Court is of the opinion that no useful purpose shall be served by keeping this matter pending any longer before this Court. However, interest of justice would be sub served if the petitioner is granted liberty to file a detailed representation with all supporting documents before the respondent no.2, the Managing Director of Bihar State Forest Development Corporation, raising all the pleas, which have been raised in the present proceeding. It is ordered accordingly.

If such a representation is filed by the petitioner with all supporting documents along with certified copy of the present order within a period of one month from today, then the respondent no. 2 and/or any other competent authority shall be obliged to consider and decide the representation of the petitioner strictly in accordance with law by a reasoned and speaking order. If on consideration of the materials respondent no. 2 and/or any other competent authority come to a conclusion that the claims raised on behalf of the petitioner are admissible to him, then consequential order shall also be issued for grant of such admissible claims without any unnecessary delay.

Entire exercise must be completed by the respondent no. 2 and/or any other competent authority within a maximum period of six months from the date of filing of the representation
