JUSTICE JAYANANDAN SINGH ORAL ORDER 3 19-06-2013 Learned senior counsel for the petitioner seeks permission to withdraw this application with liberty to the petitioner to file an appeal against the impugned order of the SubDivisional Officer cancelling PDS dealer’s licence of the petitioner. However, he submits that the appeal may be directed to be considered and disposed of on merits within the time fixed under law itself.

This writ application is, accordingly, dismissed as withdrawn with liberty to the petitioner to file an appeal before the Appellate Authority. If appeal is filed within three weeks, the Appellate Authority shall condone the delay, if any, hear the parties, consider and decide the same on its own merits positively within three months from the date of filing of the appeal.
