JUSTICE MIHIR KUMAR JHA ORAL ORDER 2 15-04-2013 Having regard to the fact that the petitioner has a statutory forum of filing a Memorial against the order of dismissal passed by the Superintendent of Police as affirmed by the D.I.G. in appeal, this Court is not inclined to entertain this writ application for the present.

Counsel for the petitioner, however, apprehends that as the disposal of the appeal had consumed a period of nine years, the pendency of Memorial also may deprive petitioner from getting his due for a long period of time. Though this Court will not now like to make any comment on the delay in disposal of the appeal of the petitioner as he did not choose to raise this issue earlier prior to disposal of his appeal but then this much must be observed that if the petitioner files a Memorial before the Director General of

Police within a period of one month from today, the same shall be disposed of within four months of filing of the Memorial by the petitioner.
