The petitioner is aggrieved by the order dated 02-08-2012 passed by learned Sub Judge- 1st Benipur, Darbhanga in Title Suit No. 39 of 2010 whereby he dismissed the petitions dated 13-02-2012 and 05-04-2012 filed by the petitioner. Learned counsel for the petitioner submits that the petitioner is defendant No.4 in the court below. An injunction petition was filed by the plaintiff in which order of status quo was granted by the court below against respondents/ defendants Nos. 1, 2 and 3. He submits that though injunction petition was filed on 06-04-2010 under Order 39 Rule 1 and 2 of the Code of Civil procedure, the same is not being disposed of in violation of mandatory provisions under Order 39 Rule 3(A) of the Code of Civil Procedure.
