2 08-02-2013 Heard learned counsel for the petitioner and learned counsel for the respondent-Indian Oil Corporation. The petitioner is aggrieved on account of the grant of highest marks to one Rakesh Kumar in the selection process for grant of Kisan Seva Kendra Retail Outlet. The petitioner having secured 90.73 total marks out of 100 is at 3^rd position, respondent no. 4 Rakesh Kumar has obtained 91.62

marks and one Anil Kumar Singh has obtained 90.70 marks.

It is the allegation of the petitioner that the same land has been given on lease for 30 years by two registered lease deeds of the same date by the mother of Anil Kumar Singh both to Rakesh Kumar as also to Anil Kumar Singh which amounts to playing a fraud upon the respondent-Corporation and thus the petitioner ought to be allotted the Kisan Seva Kendra Retail Outlet.

Learned counsel for the petitioner submits that the petitioner has already brought the said fact to the notice of the Senior Divisional Retail Sales Manager, Indian Oil Corporation Limited by her representation dated 4.2.2013.

In the guidelines for selection, it is clearly provided that any complaint made by an aggrieved person shall be duly investigated in accordance with the Complaint/Grievance Redressal procedure laid down in the Brochuer. Let the representation dated 4.2.2013 of the petitioner be treated as complaint and appropriate action in terms of the guidelines be taken by the respondent-Indian Oil Corporation in the matter in the manner and time frame set out in the Guidelines.

Until the complaint is finally disposed of, the Letter of Intent shall not be issued.

The writ application is, accordingly, disposed of with the aforesaid directions.
