2 14-11-2013 The petitioner’s Public Distribution System licence was cancelled by order of the Sub-Divisional Officer, East Muzaffarpur and the same was communicated to the petitioner under memo no. 181 dated 02.03.2013, which is Annexure 4 to this writ petition. The same has been challenged before this Court in this writ petition.

In my view, there being remedy of appeal against the impugned order, the petitioner would be well-advised to file an appeal before the appellate authority, which is the Collector-cumDistrict Magistrate, Muzaffarpur in the matter at the first instance and then if aggrieved the petitioner may, if so advised, approach

this Court.

In view of the aforesaid fact, I am not inclined to entertain this writ petition. Liberty is granted to the petitioner to file an appropriate appeal and if the appeal so filed within one month from today, the appellate authority would consider the same on merit and dispose it off within a period of three months after hearing the parties.

With the aforesaid observation, this writ petition stands disposed of.
