Having regard to the fact that the petitioner has a grievance as with regard to his promotion in the B.A trained pay scale, the remedy for the petitioner in the first instance, in terms of 2011 Promotion Rules, will be only before the Regional Deputy Director of Education who has been empowered to decide such appeal against any grievance relating to promotion in the B.A trained pay scale.

That having been not done, this writ application without exhausting the statutory alternative remedy is wholly misconceived and is, accordingly, dismissed.

The dismissal of this writ application, however, will

not stand in the way of the petitioner in moving before the Regional Deputy Director of Education for redressal of her grievance and in the event if the petitioner will do so, the appellate authority shall decide the matter without being prejudiced by the dismissal of this writ application.
