JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 6 17-06-2013 Grievance of the petitioner against the act of the State in evicting her from the piece and parcel of land seems to be valid especially in view of the fact that land in question is not a public land within the definition of the Public Land Encroachment Act and if there is a dispute with regard to the right and title, which the petitioner has acquired, which has to be settled through a civil court of competent jurisdiction. The State cannot take law in its own hands and act as an agency to remove encroachment from such kind of land.
