Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application has been filed for the grant of regular bail to the petitioner who has been made an accused in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

The case is instituted against unknown. Petitioner’s name appears emerging during investigation on recovery of some of the alleged stolen articles. Submission is of false implication and petitioner carries one Kabari shop and almost under similarly situated circumstances co-accused has already been released on bail vide order dated 19.08.2010 passed in Cr. Misc. No. 27690/2010. Further, petitioner carries no criminal antecedent since before, though, on recovery of the articles he has been roped in another case bearing Chandramandi P.S. Case No. 24/2010 also.
