After having heard the parties, and on consideration of the materials available on record as also the averments made in the counter affidavit filed by the State of Bihar in compliance of the order dated 24.1.2013 passed by this Court, this Court does not find any good ground to interfere with the impugned order dated 4.7.2011 passed by the learned Additional sessions Judge, Fast Track Court No.5, Nalanda in Sessions Trial No. 659 of 2008, whereby prayer for discharge made on behalf of the petitioner has been rejected.
Consequently, the application stands dismissed.
