counsel draws the attention of this Court to Annexure-2, which is the power of attorney executed by the informant in favour of another co-accused Mahesh Roy on 8.5.2012, in which the petitioner has also signed as a witness. Copy of money receipt has also been brought on record dated 15.5.2012 which discloses that the informant has received Rs. 8 lacs in lieu of the lands sold by the other co-accused based on the said power of attorney. Learned counsel has further submitted that there is a title suit pending between the informant and his other co-sharer with regard to various lands including the lands in question being Title Suit No. 546 of 2012, copy of which has been made Annexure3/A in the application. He refers to para 26 of the plaint which discloses that the parties were aware that the petitioner had executed the power of attorney based on which sale deed has been executed and which were sought to be challenged before the Court. It is further submitted that the petitioner has no criminal antecedent.
Learned APP for the State opposes the prayer for anticipatory bail.
Considering the facts and circumstances of the case, in the event of arrest or surrender before the Court below within four weeks from today, the petitioner be enlarged on bail upon
