This is second attempt on behalf of the petitioner, whose prayer was earlier refused vide order dated 24th January, 2013 passed in Cr. Misc. No. 41341 of 2012 with a liberty to renew the prayer, if so wishes, before the trial court after examination of the informant, who said to be solitary eye-witness and simultaneously the trial court was also directed to ensure early examination of the informant or eye-witness, if any. However, the petitioner unsuccessfully availed the liberty. Having regard to the statement of the informant made during trial, I find no reason to change the stand already taken vide order aforementioned. Hence, the prayer for regular bail of the above named petitioner, in connection with Sessions Trial No. 1569 of 2010 arising out of Mokama P.S. Case No. 234 of 1996, pending before Additional Sessions Judge – IIIrd, Barh, is hereby refused. Simultaneously, trial court is directed to proceed expeditiously with the trial and avoid undue delay and adjournments.
