JUSTICE AKHILESH CHANDRA ORAL ORDER 4 14-08-2013 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is second attempt on behalf of the petitioner. Earlier, petitioner’s prayer was refused vide order dated 27.07.2012 passed in Cr. Misc. No. 14844/2012 in connection with Session Trial No. 1035/2012 (corresponding to Belhar P.S. Case No. 86/2011) pending before 1st Additional Sessions judge, Banka, with a direction to the court below to proceed expeditiously and avoid undue delay and adjournments and as is evident from the report of the trial court that trial has now commenced on 3rd April 2013, but none out of seven witnesses have been examined.
Having regard to the facts and circumstances emerging and as mentioned in previous order, prayer for bail of the petitioner is refused. Trial court is directed to proceed expeditiously and do all needfuls to ensure its expectation true to conclude the trial within four months.
Let a copy of this order be communicated to the court below as aforesaid through Fax at the cost of petitioner.
