The petitioner is aggrieved by the order dated 26.3.2012 passed by the District Education Officer, Lakhisarai authorizing Respondent No8 to function as incharge Head Master of the Upgraded Middle School, Titachak.
Both the petitioner and Respondent No8 are stated to be Panchayat Teachers.

relevant or necessary to notice in view of a judgment reported in 2012 (2) P.L.J.R. 587 (Meena Sinha vs. State of Bihar & Ors.) cited on behalf of Respondent No.8. The controversy likewise was with regard to appointment as incharge Head Masters amongst Panchayat Teachers. A Coordinate Bench by a considered order has held that under the relevant Rules, Panchayat Teachers did not qualify for appointment as Head Master/Mistress.
Applying the principles of service jurisprudence it has further been held that a person not eligible to be substantively appointed could not be given charge by way of a working arrangement which would amount to making a “farce” of the Rules.
No further discussion is required that the entire controversy between the petitioner and Respondent No8 stands fully covered. Both of them are not eligible to be appointed as Head Master. The claim and the impugned order both collapse.
The Principal Secretary, Department of Education is required to proceed in accordance with the directions contained in the case of Meena Sinha (supra).
The application is dismissed.
