Heard learned counsel for the petitioner and the counsel for the State.

Annexure – 2, dated 18.02.2008 quashed for the reason that the Additional Registrar, Cooperative Society, Bihar has failed to give any reason on the legal objections raised by the petitioner, which is evident from reading of the said Order.

Counsel for the petitioner seems to be correct on that aspect of the matter on perusal of the order and therefore, Annexure – 2 requires interference. It is quashed and matter is remanded back to the Additional Registrar, Cooperative Society, Bihar at Patna that he will issue a notice to the petitioner, give him a hearing and decide the question raised by him afresh,

irrespective of the order, which had been passed in terms of Annexure – 2.

Since it is an old matter, the Court expects an adjudication within a period of six months from the date of production of a copy of this Order.
