4 14-09-2012 Heard learned counsel for the petitioner and the State. 2. By filing this writ petition, prayer has been made to direct the State- respondents as also the Zila Parishad, Banka to restore the possession of Thakur Pratap Narayan Deo Charitable Hospital, Bhausi to the petitioner in the light of the contents of the indenture dated 7.9.1914, Annexure-1 to the writ petition. In this connection, petitioner invited the attention of the authorities by filing several representations, which were addressed to the District Magistrate and Deputy Development Commissioner, Banka, copy

whereof is contained in the writ petition, but in spite of notice issued by this Court, the authorities of Zila Parishad, Banka have not chosen to respond to the request made by the petitioner for restoration of the possession of Thakur Pratap Narayan Deo Charitable Hospital, Bhausi to her.

As the Respondent- authorities of the Zila Parishad, Banka are not even appearing in the matter, I have no option, but to direct Zila Parishad, Bank through the Deputy Development Commissioner, Banka to consider the request of the petitioner contained in her representations dated 26.4.2011 and 22.6.2011, Annexures-4 and 5 in the light of the contents of the indenture dated 7.9.1914, Annexure-1 within a reasonable time, not exceeding one month from the date of receipt/ production of a copy of this order before the Deputy Development Commissioner, Banka. In case, the Zila Parishad is not inclined to restore the possession of Thakur Pratap Narayan Deo Charitable Hospital, Bhausi to the petitioner, the Deputy Development Commissioner, Banka should pass reasoned order within the same time.

The writ petition is, accordingly, disposed of.
