3 09-08-2012 Heard learned counsel for the petitioner and the University. No one appears for the respondent nos.3 and 4, Secretary and Principal of the College concerned, despite valid service of notice.

The petitioner is stated to be a lecturer in the department of Anatomy at the Niteshwar Ayurved Medical College and Hospital, Muzaffarpur. He desires issuance of an experience certificate for duties discharged by him from the date of appointment stated to be 22.7.1985 till 4.10.2005.

It appears from the pleadings that the college granted him an experience certificate on 21.12.1988 to the effect that he worked as a lecturer in the department of

Anatomy with effect from 22.7.1985. The petitioner contends that the list of lecturers published on 16.9.1989 itself demonstrates that he worked in the department of Anatomy from 22.7.1985 till 16.9.1989. But, another list was published on 31.10.1990 which showed him as working in the department of Anatomy since 22.7.1985. On 7.2.1992, at the request of the petitioner experience certificate was issued that he had been working for more than six years in the department of Anatomy. He is aggrieved by the information furnished to him under the R.T.I. Act on 19.8.2009 with regard to the aforesaid six years where he has been classified as working in the E.E.N.T. Department.

Learned counsel for the petitioner submits that these two documents read together may create confusion rendering the certificate useless. In absence of the college responding to the notice, let the Registrar of the University, examine the grievances of the petitioner and ensure that a fresh experience certificate in accordance with law is made available to the petitioner within a maximum period of two months from the date of receipt/production of a copy of this order.
