In the departmental proceedings, the petitioner has been dismissed from service. Appeal against the dismissal order has also been dismissed. After the decision of appeal, petitioner has been acquitted from the criminal charges. Thereafter petitioner again filed review before the appellate authority which has been rejected without considering the acquittal order. The charges appear to be on same set of facts and in criminal trial the petitioner has been acquitted. Therefore, it was incumbent on the appellate authority to hear the review petition.
