	No.UP-65AT-0308 was seized on 11.12.2011 loaded with stone chips as no valid transit permit was produced by the driver in course of inspection. Learned counsel for the petitioner submits that in respect of seizure of truck, a confiscation proceeding was initiated and
	the same is still pending and there is no likelihood of its conclusion in the near future. He submits that the truck is lying
	under the open sky facing vagaries of Nature and its conditions
	may deteriorate beyond repairs. Hence, he submits that the truck

may be released provisionally pending final decision in the confiscation proceeding.

This writ application is, accordingly, disposed of with a direction to the Divisional Forest Officer, Rohtas at Sasaram (respondent no.5) to release the truck of petitioner provisionally pending final decision in the confiscation proceeding on furnishing bond or surety, as he may require and on verification of its ownership. On production of this order, Divisional Forest Officer shall intimate the petitioner the requirement of bond or surety as he may desire, positively within one week and, on furnishing of the same, he shall release the truck in favour of the petitioner immediately.
