This is second application for modification. The first application for modification, being Cr. Misc. No.37325 of 2011, was dismissed by this Court earlier on 07.12.2011. This application was filed for modification of order dated 22.12.2010 passed in Cr. Misc. No.33382 of 2010 wherein the petitioner was granted liberty to surrender before the Court below within four weeks or if he was arrested he was to be released on bail on furnishing bail bond of Rs.10,000.
It is stated that due to unavoidable circumstances petitioner did not surrender within the time stipulated. He has now surrendered before the Court below and his regular bail application would be considered only after this application for modification is withdrawn.
Considering the facts as noted in the earlier order aforesaid, it is directed that the petitioner, namely, Arbind Kumar, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of C.J.M., Buxar in connection with Dumraon P.S. Case No.158/09 (G.R. No.1559/09).
Let a copy of this order be communicated to the Court below by FAX at the cost of the petitioner.
