Mr. Choubey submits that the very Ceiling Case No. 9 of 2000 which is put to question in Title Suit No. 139 of 2001 stands disposed of thus rendering the suit infructuous.

Proceedings arising from Ceiling Case No. 9 of 2000 stands disposed off, submits that a statutory appeal against the order passed in the Ceiling Proceedings, has been filed by the plaintiffsopposite parties and which is pending before the Appellate Authority.

Considering the submissions of the learned counsel appearing for the contesting parties, this Court is of the opinion that in the circumstances, the proper course would be to afford liberty to the petitioners to bring this aspect before the learned trial Court and who shall consider and dispose of the same in accordance with law.

With the observation aforesaid, this civil revision application is disposed of.
