Heard Mr. Shiv Kumar Dwivedy, learned counsel for the petitioners.

This civil revision application is directed against the order dated 9.1.2012 passed by learned Sub Judge-III, Bettiah, DistrictWest Champaran in Misc. Case No. 8 of 2005 whereby the learned Court below while considering the objection raised by the petitioners under Order 7 Rule 11 of the Code of Civil Procedure (hereinafter referred to as the ‘Code’) as to the maintainability of the application filed by the opposite parties under Order 9 Rule 13 of the Code, has rejected the objection inter alia on grounds that the judgment and decree passed in Partition Suit No. 148 of 1966/15 of 1974 being ex parte, the application was maintainable.

The reasons assigned by the learned Court below for rejecting the objection of the petitioners as to the maintainability of the application under Order 9 Rule 13 of the Code preferred by the opposite party 1^st set, are within the parameters underlying the entertaining of an application filed under Order 9 Rule 13 of the Code and calls for no interference.

This civil revision application is accordingly, disposed of.
