3/ 17/03/2011 Learned counsel for the petitioner submits that the earlier prayer for amendment of the plaint was rejected on 1.8.1997, as apparent from the order-sheet.
Unfortunately, an incorrect submission was made on behalf of the petitioner that it had stood rejected on 27.8.2007. This shall, however, not detract from the factum of actual rejection on
1.8.2007 which could not be brought to the attention
of the Court leading to an error in the order-sheet.
Prayer is therefore made to withdraw the
application to seek remedies before the court below itself where Title Suit No.72/96 is pending in context of the order dated 1.8.1007 with regard to the
consideration done on 17.1.2008.
The writ application is dismissed as
withdrawn with the liberty as aforesaid.
