State.
The petitioner is in custody and seeks bail in a
case registered under sections 406, 409 420, 467,468,471,
and 120B of the Indian Penal Code.
The allegation as set up in the first information
report is that the petitioner for the benefit of other coaccused persons had issued fake money orders amounting to Rs. 5,000/-, which has been detected in course of the
departmental inquiry.
It is submitted on behalf of the petitioner that co-
accused Munna Kumar Rai had deposited the concerned amount. It is also submitted that there has been inordinate delay in lodging the first information report. The petitioner is stated to be in custody since 09.01.2010.
Having regard to the facts and circumstances of the case, I direct the abovenamed petitioner, SATYA NARAYAN RAM, to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Arrah, in Barahara Police Station Case No. 292 of 2009 with further condition that one of the bailors must be close relative or family member of the petitioner, who shall state on affidavit before the court concerned giving complete genealogy as to how he or she is
related with the petitioner. It is further directed that the petitioner shall remain present on each and every date in course of the trial before the court concerned. If the petitioner fails to remain present on two consecutive dates in course of the trial without any reasonable cause shown by him, the court concerned would be at liberty to take steps
for cancellation of his bail bonds.
