The controversy in this case revolves around grant of recognition to Dayanand Ayurvedic Medical College and Hospital, Siwan, based on the requirement for a recommendation by the Central Council of Indian Medicine under Section 13 C of the Indian Medicine Central Council Amendment Act, 2003 and the grant of recognition thereafter by the Union of India.

Learned Counsel for the petitioner submits that he has no objection to the disposal of this writ application in terms of the order dated 21.1.2009 in CWJC No. 15774 of 2008 on a similar issue with regard to Sri Moti Singh Jageshwari Ayurvedic Medical College.

The petitioner- Institution was inspected for the purpose of recognition on 15.3.2008. Based on this inspection a notice of deficiencies was given on 29.7.2008. The Institution replied on 8.8.2008 and which reply makes it manifest that certain deficiencies still remained to be removed. On 28.8.2008 the

Union of India communicated that in absence of removal of all deficiencies it was not possible to grant recognition for the Session 2009-2009.

Learned Counsel for the petitioner submits that by a communication dated 14.11.2008 made to the respondents all the deficiencies have been removed and fresh inspection has also been held.

This Court for the reasons already discussed in detail in the order dated 21.1.2009 in CWJC No. 15774 of 2008 considers it appropriate to issue similar direction to the CCIM to take a

final decision in pursuance of such fresh inspection and make appropriate recommendation to the Union of India for the Session 2009-2010 within a maximum period of three weeks from the date of receipt and/or production of a copy of this order before it with a consequent direction to the Union of India to take such appropriate decision based on the nature of the recommendation within a maximum period of one month from the date of receipt of such recommendation from the CCIM. The writ application stands disposed with the observations and directions indicated above.
