The petitioners, who are the family members of the

husband, apprehend arrest in a Police case under Sections 498A

and other provisions of the Penal Code and Sections 3 & 4 of the Dowry Prohibition Act.

The submission is of generalized allegations against

the petitioners as family members. It is fairly acknowledged that the anticipatory bail application of the husband has been rejected by the court below. Case No. 164 of 2008 referred to in the allegations has also been withdrawn by the informant.

In the facts and circumstances of the case, let the petitioners, abovenamed surrender in the court below within a period of four weeks from today, when they shall be enlarged on provisional anticipatory bail for a period of three months on furnishing bail bonds of Rs. 10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Dalsingsarai, Samastipur in Dalsingsarai P.S. case No. 141 of

If during this period of three months, the husband of the victim either obtains bail or surrender to custody, the court below shall proceed to confirm the provisional bail of the petitioners. If the husband continues to evade the law after the expiry of three months, the court below shall not confirm the provisional bail of the petitioners, when they shall be taken into custody and any application for regular bail on their behalf shall be considered by the court below on its own merits without being prejudiced by the present order.
