03. 1. This writ petition in the nature of habeas corpus is taken out for a direction to the opposite party Nos.1 to 3 to take appropriate steps to rescue the minor daughter of the petitioner.

2. An instruction has come to be received by Mr. Sanjay Rath, learned Addl. Government Advocate from the Inspector-in-Charge, Nayapalli Police Station, which reveals that on 01.03.2026 the victim girl appeared before the Police Station and got her statement recorded by a Lady Sub-Inspector of Police and on the same day, as per the direction of the IIC, Nayapalli Police Station, she was sent to Sakti Sadan Shelter Home, Tamando for her safe custody. On 02.03.2026, the victim was taken to Capital Hospital, Bhubaneswar for Medico-Legal Examination, but she refused to undergo such examination. Thereafter, she was produced before the Child Welfare Committee (CWC), but the Chairperson of the CWC observed that since the victim is above 18 years of age, the matter does not fall

within the purview of the CWC and directed her to stay at the above Shelter Home.

It is further revealed from the said report that on 07.03.2026 the victim girl was produced before the Court of learned J.M.F.C.-III, Bhubaneswar where her statement under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (in short, 8BNSS9) was recorded. In her statement, she stated that she had left her house on her own volition and had gone to Gujarat and that no person had kidnapped or induced her. After her statement was recorded, she was sent to said Sakati Sadan Shelter Home, Tamando for her safe stay. The report furnished by the learned Addl. Government Advocate is taken on record.

In view of the above development, since the minor girl has already been rescued and got her statement recorded under Section 183 of the BNSS and now sent to Shelter Home for safe stay there, this Court does not feel it appropriate to keep the instant writ petition pending, as it would not subserve any fruitful purpose. It is open for the petitioner to move before the CWC again for appropriate instruction (s).

5. Accordingly, the WPCRL stands disposed of.
