Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner has approached this Court with the following

“It is therefore pray that, your Lordship's may graciously be pleased to admit the writ application having heard from the both parties allow the writ petition to the extent that;-

i) To issue appropriate writ/order/direction by directing the state opp. parties more particularly Learned Tahasildar Mahanga "here in referred as opp. party No.2" to take proper initiation/diligent steps to fixing an early date for final adjudication of objection petition /Misc. Case petitioner arising out of Mutation Case No.11897/2025 and give complete relief to the petitioner as time stipulated by this Hon'ble Court. And pass any other order/orders as deem fit and proper in the interest of justice .

And for this act of kindness petitioner as in duty bound shall ever pray.”

In course of hearing, it is brought to the notice of this Court that the petitioner has already preferred a revision before the Addl. Commissioner, Consolidation and Settlement being R.C. Case No.223 of 2024. It is submitted that in the meantime, the Tahasildar, Mahanga has corrected the ROR in question. It goes without saying that the correction of ROR cannot be treated as the final in view of the pendency of the revision under Section 37(1) of the OCH & PFL Act. If any correction has been made, it is but natural that the same shall be subject to the result of any order that may be passed by the revisional authority.

The writ application is disposed of with the above observation, granting liberty to the petitioner to pursue the revision filed by him.
