Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the StateOpposite Parties. Perused the writ application as well as the prayer made therein.

The Petitioner has filed the present writ application with the following prayer:

“Therefore, it is prayed that this Hon’ble Court may graciously be pleased to issue rule nisi to Opposite Parties 2 and 3 to show cause as to why a direction shall not be issued to appoint the Petitioner under the provisions of the Odisha Civil

Service (Rehabilitation Assistance) Rules, 1990, read with the Odisha Civil Service (Rehabilitation Assistance) Amendment Rules, 2016 & 2020, on the basis of the Petitioner’s application dated 28.05.2025, vide Annexure-2, on the grounds stated in this petition and the Opp. Parties showing no cause or insufficient cause or cause not to the satisfaction of this Hon’ble Court, the writ petition may be allowed.

On perusal of the writ application, it appears that the father of the Petitioner, namely, late Pradeep Kumar Padhi, who was working as an Assistant Teacher at U.G.H.S., Ambapua under Bellaguntha Block in the district of Ganjam, died in harness on 10.06.2022. After death of his father, who was a government employee, he being the only legal heir applied for employment on compassionate ground. Before such filing of the application, the mother of the Petitioner also died on 14.06.2013 and at the relevant point of time the Petitioner was a minor. Therefore, he was unable to submit an application for appointment on compassionate ground under the Rehabilitation Assistance Scheme. Finally on attaining the age of majority, the Petitioner submitted application for appointment on compassionate ground on 28.05.2025 at Annexure-2 to the writ application along with the requisite documents.

Learned counsel for the Petitioner contended that the application of the Petitioner was duly forwarded by

the Block Education Officer, Bellaguntha, Opposite Party No.3 to the District Education Officer, Ganjam, Berhampur, Opposite Party No.2, vide letter dated 29.05.2025 at Annexure-6. It is further submitted that although application of the Petitioner was duly filed up along with requisite documents and submitted before the Block Education Officer, Bellaguntha, Opposite Party No.3, no final decision has been taken. Being aggrieved by such inaction of the Opposite Party No.3, the Petitioner has approached this Court by filing the present writ application.

It is submitted by the learned counsel for the State that taking into consideration the grievance of the Petitioner involved in the writ application and the fact that the application of the Petitioner is pending for consideration before the Opposite Party No.2, he has no objection if a direction is issued to the Opposite Party No.2 to consider the application of the Petitioner in accordance with law and dispose of the same within a stipulated time.

Considering such submissions made by the learned counsel for the parties and taking into account the limited grievance involved in the present writ application, this Court disposes of the writ application directing the Opposite Party No.2 to consider the grievance of the Petitioner and take a final decision on the application of the Petitioner for appointment on compassionate grounds as has been forwarded by the

Block Education Officer, Bellaguntha, Opposite Party No.3 within a period of two months from the date of communication of this order. The final decision so taken be communicated to the petitioner within ten days thereafter.

With the aforesaid observations and directions, the writ application stands disposed of.
