Heard learned counsel for the Petitioner as well as learned Additional Government Advocate for the State-Opposite Parties. Perused the writ petition as well as documents annexed thereto.

The present writ petition has been filed by the petitioner with the following prayers:

“ It is therefore, humbly prayed that this Hon'ble

Court be graciously pleased to:-

¶19

i) Admit the writ application.

¶20

ii) Call for the records.

¶21

iii) Issue a writ of mandamus or any other appropriate writ(s), direction(s), directing the opposite parties to treat the petitioner at par with the employees of other aided educational institutions, who were extended with grant-inaid in accordance with Grant-in-Aid Order 1994 and to

extend all benefits as applicable to the aided educational institution within the meaning of Section 3-b of the Orissa Education Act, such as Earned Leaves, Extra Ordinary Leaves as well as Study Leaves as prescribed under Orissa Education (Leave of Teachers and other Members of the Staff of Aided Educational Institutions) Rules, 1977, Pensionary and other retiral benefits as per Orissa Aided Educational Institutions Employees Retirement Benefit Rules, 1981 and GPF benefits as per Orissa Aided Educational Institution Employees General Provident Fund Rules, 1983, keeping in view the ratio decided in the case of Ritanjali Giri alias Paul-vrs-State of Orissa and others reported in 2016(1) ILR-CTC-1162 as well as the law decided in the case of Jagadish Singh Babu Vrs. State of Odisha & another (W.P.(C) No.29322/2020 disposed of on 11.08.2021) so also the judgment passed in the case of Baijayanti Nayak Vrs. State of Odisha & Ors and Hemant Kumar Chhotray Vrs. State of Odisha & Ors within a reasonable time stipulated by this Hon'ble court.

iv) And or pass any such other order/orders or direction/directions may be issued so as to give complete relief to the petitioner. ”

In course of hearing, learned counsel for the Petitioner submits that the Petitioner may be granted liberty to file a fresh representation ventilating his grievance before the Commissionercum-Secretary to Govt. of Odisha, Higher Education Department, Bhubaneswar, Opposite Party No.1 which may be considered within a stipulated period of time in accordance with law.

Learned Additional Standing Counsel on the other hand submits that he has no objection if liberty is granted to the Petitioner to file a fresh representation before the Opposite Party No.1 and the same is considered and disposed of in accordance with law.

In view of the aforesaid limited nature of grievance of the

petitioner, this Court disposes of the writ petition granting liberty to the Petitioner to file a fresh representation before the Opposite Party No.1 ventilating his grievance within a period of three weeks. If such representation is filed within the time stipulated, the same shall be considered and disposed of by the Opposite Party No.1 keeping in view the ratio laid down in W.P.(C) No.29322 of 2020 disposed of on 11.08.2021 and by following the ratio in Ritanjali Giri @ Paul vrs. State of Odisha & Others , reported in 2016 (I) ILR CUTTACK 1162 within a period of six weeks from the date of filing representation by passing a speaking and reasoned order. The decision so taken on the same shall be communicated to the Petitioner within a period of ten days from the date of taking such a decision. In the event it is found that the Petitioner is entitled to the claim made in the present writ application and there are no other legal impediments, necessary steps be taken for disbursal of such financial benefits within four weeks from the date of taking such a decision.

With the aforesaid observations/ directions, the writ petition is disposed of.
