Petitioner in this writ petition prays for the following relief:

“It is, therefore, prayed that your Lordships may graciously be pleased to admit the writ petition, call for the records, issue Rule NISI in the nature of Writ of Certiorari/Mandamus calling upon the Opp. Parties specifically the Opp. Party No.2 as to why a direction shall not be issued him to incur the expenses incidental and ancilliary for smooth functioning of the institution i.e. Baba Bokhari Saheb, Taramadan, Jajpur on collection of rent from the tenants under the institution or in the alternative to allow the Marfatdars to collect the rent and manage the institution as continuing at present in the interest of the institution;

In the event the Opp. Parties fail to show cause or show insufficient cause the said Rule be made absolute, a direction be issued to the Opp. Party No.2 to incur the expenses incidental and ancilliary for smooth functioning of the institution i.e. Baba Bokhari Saheb, Taramadan, Jajpur on collection of rent from the tenants under the institution or in the alternative to allow the Marfatdars to collect the rent and manage the institution as continuing at present in the interest of the institution.

And may pass such other order/orders, direction/directions, writ/writs as deem fit and proper;

And for this act of kindness, the petitioner shall as in duty bound remain ever pray.”

Mr. Panigrahi, learned Counsel for the Petitioner submits that earlier the matter was adjourned to file a petition for amendment, but the same has not yet been filed. He, however, prays for withdrawal of the writ petition. A memo in support of his submission is filed in the Court today, which is taken on record.

In view of the submission made by learned Counsel for the Petitioner, the writ petition is disposed of as withdrawn.
