This matter is taken up through hybrid mode.

Heard learned counsel appearing for the Parties.

¶13

The present Writ Petition has been filed inter alia with the following prayer.

“It is therefore prayed that this Hon'ble Court may be graciously pleased to issue writ / writs, order/orders under Article-226 of the Constitution of India and more particularly issue directions -

0 Writ of mandamus directing Opp. Parties to produce the relevant records along with returns;

(ii) Writ of mandamus directing the Opp. Parties to sanction draw and disburse the family pension in favour of petitioner as per the provision prescribed in the Odisha Pension Rule, 1992.

(iii) Writ of mandamus directing the Opp. Party No.3 to dispose of the representation and take necessary steps for sanction of family pension in favour of the petitioner.

(iv) Order allowing all / any other retirement benefits as would be available to the deceased family pension holder.

And pass any other order/orders direction/directions as this Hon'ble Court may deem fit and proper in the interest of justice in the facts and circumstances of the case.

And for this act of kindness the petitioner shall, as in duty bound, ever pray.”

It is contended that in spite of his eligibility Petitioner is not getting the benefit of family pension. Learned Addl. Standing Counsel on the other hand contended that since the Petitioner has not made necessary application in the prescribed format to get the benefit, the Writ Petition is not entertainable.

Having heard learned counsel for the Parties and considering the submission made, this Court while disposing of the Writ Petition permits the Petitioner to make a proper application in the prescribed format before Opp. Party No.3 for consideration of his grievance as made in the Writ Petition.

It is observed that if any such application will be made before Opp. Party No.3 within a period of three (3) weeks from today, Opp. Party No.3 shall take a lawful decision on the same within a period of three

(3) months from the date of receipt of such application.

¶26

Accordingly, the Writ Petition stands disposed of.
