2. The Petitioner has filed this Writ Petition with the following prayer:-

“ (i) To admit this Writ Application.

(ii) To quash the Eviction Notice passed against L.E. Case No.101/2025-2026 by the Tahasildar, Soro on the ground of overlapping and usurping of jurisdiction.

(iii) To direct the Revenue Authorities, Sub-Collector, Balasore and Tahasildar, Soro to proceed with the eviction

proceeding in the form of demolition of residential house out of L.E. Case No.101/2025-2026 till disposal of the R.P. Case No.141/2025 now pending in the court of Additional Commissioner Consolidation and Settlement, Balasore . “

3. Heard.

4. Learned counsel for the Petitioner submits that the Petitioner has filed this Writ Petition challenging the eviction notice passed in L.E. Case No.101/2025-2026 by the Tahasildar, Soro in respect of Plot No.1631 out of Khata No.282 of Mouza-Banisia, Tahasil-Soro on the ground of overlapping of jurisdiction because of the fact that the subject plot and land schedule are under the jurisdiction and adjudication of Additional Commissioner, Consolidation and Settlement Balasore in reference to R.P. Case No.141/2025 filed on 28.04.2025 in which the Tahasildar, Soro has also arrayed as a Party. However, the said Tahasildar has issued the form ‘Ka’ against the present Petitioner to which the Petitioner has also filed the reply before the Tahasildar, Balasore wherein it has been stated that since the Khata and Plot number of the disputed area is showing some discrepancy. Therefore, the matter is pending before the Additional Commissioner, Consolidation and Settlement Balasore bearing R.P. Case No.141/2025.

5. Considering the facts and submissions made and since Petitioner has already filed the reply to the form ‘Ka’ on

08.10.2025, this Court is of the view that let the Tahasildar, Soro restrain himself from issuing any notice for eviction till the R.P. Case No.141/2025 is decided.

6. In the meantime, the Additional Commissioner, Consolidation and Settlement, Balasore is directed to conclude the R.P. Case No.141/2025 within a period of two months from the date of presentation of a certified copy of this order.
