Heard learned counsel for the Parties.

By means of this application, the Petitioner seeks the following relief:-

“i) To quash the order dated 19.12.2025 passed by the Sub Collector, Khordha in Mutation Appeal No. 80/2025 under Annexure-4;

¶18

ii) If the opp. parties fail to show cause and / or show insufficient cause to make the rule absolute; and

¶19

iii) Pass such other writ / writs or order/ orders and direction / directions which would afford complete relief to the petitioner.”

Mr. Mohanty, learned counsel for the Petitioner, in course of the hearing in the application drew the attention of this Court to the order dated 19.12.2025, wherein the Sub-Collector, Khordha has passed the following order:-

“The case record is put up today. The learned advocate on behalf of the appellant and respondents are present and also filed hazira. The learned advocate on behalf of the

respondents sought time for hearing of the said case. Hence, the time is allowed in favour of the respondents for hearing of the said case. The learned advocate on behalf of the appellants submitted a petition that the respondents intentionally taking several adjournments and not cooperating the appeal but on the other hand, they are trying to alienate major portion of the suit property and negotiating with different intending purchaser and have also taken advance from them in order to defraud the final order and to put the appellant into serious trouble. He also prays to this court for taking necessary steps regarding the aforesaid matters.

In view of the above, the Sub Registrar, Banpur is directed not to entertain any RSD about the ROR issued by the Tahasildar, Chilika in mutation case No. 3609/2024 until the disposal of this appeal.

The case is posted to 06.02.2026.”

It further reveals from the aforesaid order that the matter was adjourned to 06.02.2026. Mr. Mohanty, learned counsel for the Petitioner has no instruction as to what transpired on 06.02.2026. However, having regard to the nature of the order passed by the Sub-Collector, Khordha, the Petitioner being on record before the said authority has every right to moot the said authority to recall the aforesaid order, wherein the Court directed the Sub-Registrar not to entertain the instrument.

The Writ Application is accordingly disposed of with a liberty to the Petitioner to move the aforesaid authority praying to recall the order dated 19.12.2025, upon an application and in that context all the contentions are opened to the parties to raise before the authority.
