Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto.

The Petitioner has filed the present writ application with the following prayer:

“It is therefore, most humbly prayed that this Hon'ble Court be graciously pleased to:-

¶18

i) Admit this writ application.

¶19

ii) Call for the records.

¶20

iii) Issue a writ in the nature of Mandamus or any other appropriate writ/writs, direction/directions, directing the opposite parties, Particularly Opp. Party No.2 to

give necessary direction/instruction to the Opposite Party no.3 (Governing Body of the Institution) to submit necessary proposal in favour of the Petitioner as against the post of Junior Clerk in prescribed form under the Grant-in-Aid Order, 2008 and further the Opposite Party No.2 may be directed to regularize/approve the service of the petitioner as against the post of Junior Clerk as per the Grant-in-aid Order, 2008 and to extend the benefit of salary components towards Grant-in-aid in his favour w.e.f his eligibility, as has been done in respect of other staff of the institution and further the petitioner may be extended with all other consequential, service and financial benefits as due and admissible, by considering the representation made by the petitioner under Annexure-5 within a reasonable time to be stipulated by this Hon'ble Court.

iv) pass other order/orders, And/or any direction/ directions as this Hon'ble Court deems fit and proper for the ends of justice.”

In course of hearing of the writ application, learned counsel for the Petitioner submits that the Petitioner ventilating his grievance has submitted representation before the Director, Higher Education Odisha, Bhubaneswar, Opposite Party No.2 under Annexure-5. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.2 to consider the representation of the Petitioner under Annexure-5 within a stipulated period of time.

Learned Additional Standing Counsel submits that he has no objection if the representation of the Petitioner is considered by the

Opposite Party No.2, which is stated to be pending, in accordance with law within a stipulated period of time.

Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party No.2 to consider the representation of the Petitioner under Annexure-5 within a period of eight weeks from the date of production of certified copy of this order. The Opposite Party No.2 shall do well to dispose of the representation of the Petitioner under Annexure-5 by passing a speaking and reasoned order. The decision so taken by the Opposite Party No.2 be also communicated to the Petitioner within ten days thereafter.

With the aforesaid observation/ direction, the writ application stands disposed of.
