Heard learned counsel for the Petitioner as well as learned Additional Govt. Advocate for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto.

The Petitioner has filed the present writ application with the following prayer:

“In the facts and under the circumstances stated

¶18

above, the Hon'ble Court would graciously be pleased to admit this WRIT application and issue;

a) A writ of and/or in the nature of Certiorari do issue calling upon the opp. Parties to transmit all records relating to the present case such that conscionable justice may be done upon considering the same

b) Rule NISI calling upon the Opp. Parties to show cause as to why the petitioner shall not be reimbursed the legal dues as contended under Annexure-2 and inaction of the O.P. in complying the same causing high prejudice to the petitioner sweeping their own latches under the carpet shall not be declared illegal and arbitrary

c) And if the O.P. fail to show cause or show insufficient cause make the said Rule absolute;

d) Issue a writ in the nature of Mandamus directing the Opposite Parties to release the payment as under Annexure-2 within a stipulated time.

e) Issue any appropriate writ(s) / direction(s) / order(s) deemed fit in the fact and circumstances of the case.”

In course of hearing of the writ application, learned counsel for the Petitioner submits that the Petitioner ventilating his grievance has submitted representation before the Chief Engineer, Odisha Police Housing and Welfare Corporation Ltd., Opposite Party No.3 under Annexure-2. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.3 to consider the representation of the Petitioner under Annexure-2 within a stipulated period of time.

Learned Additional Govt. Advocate submits that he has no objection if the representation of the Petitioner is considered by the Opposite Party No.3, which is stated to be pending, in accordance with law within a stipulated period of time.

Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of

admission with a direction to the Opposite Party No.3 to consider the representation of the Petitioner under Annexure-2 within a period of eight weeks from the date of production of certified copy of this order. The Opposite Party No.3 shall do well to dispose of the representation of the Petitioner under Annexure-2 by passing a speaking and reasoned order. The decision so taken by the Opposite Party No.3 be also communicated to the Petitioner within ten days thereafter. It is open to the Petitioner to file the copies of any judgments/ citations before the Opposite Party No.3 at the time of communicating a copy of today’s order and in such eventuality the Opposite Party No.3 shall take into consideration such judgments before passing the final order.

With the aforesaid observation/ direction, the writ application stands disposed of.
