Writ Petition (Civil) — Grant-in-Aid — Petitioner sought quashing of the Notification dated 22.06.2011 (Annexure-11), sanction and release of Grant-in-Aid in his favour with effect from 01.06.1994 under the Grant in Aid Orders, 1994, and modification of the school approval order dated 11.07.2011 (Annexure-12) and similar orders (Annexure-13 series). An earlier writ petition bearing W.P.(C) No.33757 of 2011, filed by the governing body of the school in question with an identical prayer, had been disposed of by a coordinate Bench vide order dated 10.12.2019 granting liberty to approach the State Education Tribunal. Following the same course, this Court disposed of the present writ application, granting the Petitioner liberty to file an application before the State Education Tribunal within four weeks along with a certified copy of the order, with a direction that the Tribunal shall consider the application in accordance with law. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the writ application as well as the prayer made therein.

By filing the present writ application, the Petitioner has prayed for quashing of the Notification dated 22.06.2011 at Annexure-11 and for a direction to the Opposite Parties to sanction and release the Grant-in-Aid in favour of the Petitioner with effect from 01.06.1994 as per the provision contained in Grant in Aid Orders, 1994. A further prayer has also been made with regard to modifying the approval order of the Petitioner’s School dated 11.07.2011 at Annexure-12 and other similar orders at Annexure-13 series. On a close scrutiny of the documents annexed to the present writ application, it appears

that earlier a writ petition involving similar fact was filed bearing W.P.(C) No.33757 of 2011. Earlier writ application was filed by governing body of the school in question with an identical prayer. A coordinate Bench of this Court while disposing of the said writ petition vide order dated 10.12.2019 granted liberty to the Petitioner to approach the State Education Tribunal for redressal of his grievance relating to sanction and disbursal of the grant-in-aid in favour of the Petitioner.

In view of the aforesaid order dated 10.12.2019, this Court deems it proper to dispose of the present writ application by granting liberty to the Petitioner to approach the State Education Tribunal by filing an application within a period of four weeks’ from today along with a certified copy of today’s order. In such eventuality, the learned Tribunal shall consider the application of the Petitioner in accordance with law.

With the aforesaid observation and direction, the writ application stands disposed of.
