This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.

Petitioner has filed the present writ petition inter alia with the following prayer:-

“It is, therefore, most humbly prayed that this Hon'ble Court be graciously pleased to admit the writ application, issue a Rule Nisi calling upon the Opp.Parties to show cause as to why a writ in the nature of mandamus shall not be issued commanding them, or any other direction/directions directing the Opp.parties to allow the petitioner to undergo A.S.I. training on the basis of their seniority keeping in view the prevalent Rule relating to promotion to the post of A.S.I. and the petitioner may be allowed to undergo the A.S.I. training as has been done in the case of the other candidates who have been qualified in the written test under PMR 660 and issue appropriate order/direction directing the Opp.parties to undergo the A.S.I. course training taking into consideration the petitioner long service as Constable from the date of his initial appointment. And pass any other order/orders for

the ends of justice directing the Opp.parties to extend the same benefits as has been extended to large number of Constables who were qualified in the previous written examination, which may be fixed by this Hon'ble Court within a stipulated period or may pass such other order/orders as deemed just and proper.

And for which act of kindness, the petitioner shall as in duty bound ever pray.”

However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No.3 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of two (2) weeks hence.

It is observed that if such representation is filed within the aforesaid time period, Opp. Party No. 3 shall do well to take a lawful decision on the same within a period of four (4) weeks from the date of receipt of such representation. The order so passed by Opp. Party No. 3 be communicated to the Petitioner.

With the aforesaid observation and direction, the Writ Petition is disposed of.
