1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State-Opposite Parties. Perused the writ petition as well as documents annexed thereto.

The present writ petition has been filed by the petitioner with the following prayers:

“ Under the above circumstances, it is humbly

prayed that the writ application be allowed; And

¶19

(a) a writ of mandamus or an appropriate writ be issued commanding the Opposite Party No- 1 to consider the representation of the petitioner for transfer from Malkangiri College, Malkangiri to Kesinga College, Kesinga or any nearby college of Kalahandi district within a stipulated period.

(b) And to pass such other order or orders as this Hon'ble Court deem fit & proper. ”

On perusal of the record it appears that the Petitioner had approached the Opposite Party No.1, i.e., Principal Secretary to Government, Deptt. of Higher Education, Odisha, at-Bhubaneswar by filing a representation on 21.08.2023 at Annexure-6. Further, the record reveals that there although the writ application was filed in the year 2023, the same is being listed for admission for the first time after 3 years.

Taking into consideration the aforesaid facts, the present writ application is being disposed by granting liberty to the Petitioner to approach the Opposite Party No.1 by filing a detailed representation along with supporting documents within a period of three weeks from today. In such eventuality, the Opposite Party No.1 shall consider the representation of the Petitioner strictly in accordance with law and dispose of the same by passing a speaking and reasoned order within a period of six weeks from the date of communication of a copy of today’s order. The decision so taken on the same shall be communicated to the Petitioner within a period of ten days from the date of taking such a decision.

With the aforesaid observations/ directions, the writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
