The petitioners have approached this Court with the following

“ The petitioners therefore pray that your lordship would be graciously pleased to admit this writ application, issue notice to the opposite parties and after hearing the parties allow the same with cost and issue a writ in the nature of Mandamus/Certiorari or any other/further writs/ directions directing the 0pp. Party no.2 to enter the certificate of sale in Book no-1 of his office for ends of justice or may pass any other order as this Hon'ble Court deems fit and proper, And, for which act of kindness the petitioners shall the petitioners shall be deeply obliged to this Hon'ble Court for ever”.

It is submitted that the case of the petitioners is squarely covered by the judgment passed by a Coordinate Bench of this Court in the case of Iswar Chandra Nayak -vrs. State of Odisha wherein

under paragraph no.16 the following order was observed:

“ 18. Hence, it is directed that the Registering Officer shall make an entry of the sale certificate in Book-I on being moved by the petitioner. It is further observed that this order shall not in any manner stand on the way of the Competent Authority to test the validity of the sale certificate, if permissible”.

Learned State Counsel fairly submits that the case of the petitioners is squarely covered by the ratio of the above mentioned judgment.

Considering the above facts, the writ application is disposed of granting liberty to the petitioners to approach the Sub-Registrar, Udala, Mayurbhanj by filing a representation enclosing copy of the judgment in Iswar Chandra Nayak (Supra). If such representation is submitted within a week, the Sub-Registrar, Udala, Mayurbhanj shall consider the same in light of the ratio decided in Iswar Chandra Nayak (Supra ) and pass appropriate orders within one week thereafter.
