The additional affidavit and I.A. filed by Mr. Pal in Court are kept on record.

It is submitted on behalf of the Petitioners that, Pattamundai Municipality has now started construction of RCC retaining Wall in front of the private plot of Petitioners, without having any right over the same, causing hindrances to the ingress and egress of residents/occupants of Petitioners building.

It is further submitted that in this regard the Petitioners may be permitted to submit a representation to the Collector.

Accordingly, the writ petition is disposed of at the stage of admission, without expressing any opinion on the merits of contentions of the Petitioners, permitting the Petitioners to make a

representation in writing ventilating their grievances to the Collector, Kendrapada (Opposite Party No.4) within a period of seven days from today and in such event, Opposite Party No.4 shall consider the grievance of the Petitioners and take decision in accordance with law, within a period of eight weeks thereafter. If necessary, the Petitioners may be given an opportunity of hearing. Till such decision is taken by Opposite Party No.4, the construction of RCC retaining Wall over Plot No.1960, i.e. as per Item Nos.55, 56 & 57 of Tender Call Notice (NIT) dated 23.03.2026 of Housing and Urban Development Department, shall not be proceeded with.

The Petitioners are directed to serve certified copy of this order along with a copy of the writ petition and the additional affidavit along with their representation.
