1. This matter is taken up through hybrid arrangement.

2. Heard learned counsel for the parties.

3. In this Writ Petition, the Petitioners seek for a direction from this Court to the Opposite Party No.4/Tahasildar, Banpur to consider their application under Annexure-2 for settlement of the land in question in their favour.

4. During course of hearing learned counsel for the Petitioners submits that the Petitioners have filed an application under Section 8(A) of the OPLE Act for settlement of the land in question before the Tahsildar, Banpur which is still pending for adjudication.

Considering the submission made by the learned counsel for the parties and without going into the merit of the case, this Court directs the Petitioners to approach the Opposite Party No.4/Tahasildar, Banpur afresh for settlement of the land in question in their favour as per the provision under Section 8(A) of the OPLE Act, 1972 by filing of an application within fifteen working days hence and the said application of the Petitioners shall be disposed of within a period of 60 days thereafter in accordance with law.

It is further directed that, if the Petitioners approach the Tahasildar, Banpur as per the above noted provision within the time stipulated herein above, no coercive action shall be taken against the Petitioners pursuant to the notice dated 02.01.2003/Annexure-1, till the matter is taken up by the Tahasildar, Banpur.

7. Accordingly, the Writ Petition is disposed of.
