Heard learned counsel for the Petitioner and learned Additional Government Advocate for the State-Opposite parties.

The petitioner is aggrieved by the publication of not-final Hal ROR by the Assistant Settlement Officer on 18.02.2021. The said not-final ROR is recorded in the name of the G.A. Department. The petitioner, desiring to file an objection under Section 12 of the Odisha Survey and Settlement Act, 1958 approached the Assistant Settlement Officer, Cuttack. His grievance is that his objection is not being entertained.

Learned State counsel submits that objections against such publication was being accepted till August, 2025, but not thereafter.

To this, learned counsel for the petitioner submits that unless his objection is considered, he would be seriously prejudiced as the land has been recorded in the name of the G.A. Department.

Since, according to the petitioner, his valuable right has been infringed by publication of not-final Hal ROR, the Writ Petition is disposed of granting him liberty to submit objection before the concerned authority within ten days from today. If such objection is filed along with an application for condonation of delay, the authority shall consider the same and pass appropriate order in accordance with law. It goes without saying that the application for condonation of delay shall be considered at the first instance.
