01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel appearing for the Parties.

Even though the present Writ Petition has been filed inter alia challenging the notice issued on 12.08.2026 under Annexure-7 directing the Petitioner to vacate the Government Quarter bearding No.E-2/2 and a contention was raised that since Petitioner’s original posting is at Malkangiri which comes under KBK area, Petitioner is entitled to continue in the quarter, but in course of hearing, learned counsel appearing for the Petitioner fairly contended that if Petitioner will be allowed time till 31.10.2026, he will vacate the quarter suo-motu.

4. Learned Addl. Standing Counsel for the State has no serious objection to the submission made by the learned counsel appearing for the Petitioner.

Considering the submission, this Court while disposing the Writ Petition without interfering with the impugned notice dtd.12.08.2026 permits the Petitioner to continue in the quarter in question till 31.10.2026. However, Petitioner is directed to vacate the quarter suo-motu by 31.10.2026. Petitioner is also directed to furnish an undertaking in that regard before Opposite Party No.4 along with copy of this order that he will vacate the quarter suo-motu by 31.10.2026.

6. Accordingly, the Writ Petition stands disposed of.
