The petitioner has approached this Court with the following

prayer:

“The petitioner therefore most humbly prays that this Hon’ble Court may be graciously pleased to admit this case after hearing both the sides may be pleased to issue a writ of mandamus/certiorari or any other writ or direction which will deem fit and proper to this case;

(i) By directing Sub-Collector, Bargarh to consider the petitioner filed by Petitioner dtd. 20.10.2023 which has registered as letter No. 4479/dtd. 20.10.2023 still pending. No reasonable opportunity given to the petitioner to afford his evidence.

(ii) By quashing order dated 21.04.2023 passed by Tahasildar, Bhatli in Mutation Case No. 233/23 rejecting the mutation case on the ground permission is require prior to transaction under OLR Act;

(iii) And further be pleased to pass any order/orders as deem fit and proper to this case by allowing the application similar

situated persons obtaining ROR from Tahasildar, Bhatli without prior permission under O.L.R. Act; And for this act of kindness, the petitioner shall as duty bound ever pray.”

Since order impugned can be challenged in appeal before the appropriate authority, the writ application is disposed of granting liberty to the petitioner to prefer an appeal within two weeks from today. If such appeal is preferred within the stipulated period along with an application seeking condonation of delay, the same shall be considered liberally and the appeal shall be heard on its own merits.
