01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.

2. Heard learned counsel for the Parties.

3 . Petitioner has filed the present Writ Petition with the following prayer:-

“The petitioner therefore prays this honorable court may kindly be pleased to issue writ in nature of mandamus in directing the opposite parties to validate as notional regularization of service of the petitioners' husband as in serial number 486 in ANNEXURE-5 dated 24.2.2026 for the purpose of grant of pension to her husband & then for family pension under OCS Pension Rule 1992.

AND further may direct the opposite parties to process the application under OCS Pension Rule 1992 and the same may grant family pension from March 2026 within a period of 3 months & monthly family pension as per the Rule.

OR in alternative this case being covered by decisions of this court in case of Ch. Gouri prabha in WP (C) NO8081/2025 D.O. 247.3.2025 & case of

state of Odisha versus Basanti Das in WA NO 1598//2024 D.O. 2.2.2026. may direct them to grant family pension in parity of the same.

And/Or any other order or orders be passed by modulating the prayer in the interest of justice.

And for this act of kindness, the petitioner as in duty bound shall ever pray.”

4. However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a detailed representation before Opp. Party No.4 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, Opp. Party No.4 shall do well to take a lawful decision on the same within a period of three months from the date of receipt of such representation. The order so passed by the Opp. Party No.4 be communicated to the petitioner within the aforesaid time period.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
