This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel appearing for the Opp. Parties.

Petitioner has filed the present writ petition inter alia with the following prayer:-

“It is, therefore, prayed that this Hon'ble Court may graciously be pleased to issue notice to the opp. Parties calling upon them to file show cause as to why :-

i) A direction shall not be issued to the opp. parties to release pension and pensionary benefits in favour of the petitioner by counting the period of service rendered under work charges establishment w.e.f.01.12.2011 till his superannuation dated 31.7.2023 as per the provisions of Rule 18 (3) of OCS Pension Rules, 1992 as well as the Judgment of Hon'ble Apex Court of India rendered in between Dharam Singh and others Vrs State of U.P. and others in Civil Appeal No.8558/18 dated 29.08.2025 as well as Judgment of Hon'ble Apex Court of India rendered in between Bhikhani Devi and Etc Vrs Union of India and others in Civil Appeal No. 8354 - 8356 of2026 dated 1.6.2026

ii) And after hearing the parties be pleased to direct to release pension and pensionary benefits in favour of the petitioner by 01.08.2023 counting the period of service rendered under work charges establishment w.e.f. 01.12.2011 till his superannuation dated 31.7.2023 as per the provisions of Rule 18 (3) of OCS Pension Rules, 1992 along with all arrears ; within a date to be fixed by this Hon'ble Court;

And pass any other order/orders, direction/ directions as deemed fit and proper;

And for which act of kindness, the petitioner shall as in duty bound, ever pray.”

However, taking into account the claim raised in the present Writ Petition, liberty is granted to the Petitioner to make a fresh representation before Opp. Party No.1 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three (3) weeks hence.

It is observed that if such representation is filed within the aforesaid time period, Opp. Party No.1 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No.1 be communicated to the Petitioner.

With the aforesaid observation and direction, the Writ Petition is disposed of.
